PROCEDURES FOR LABOR REGISTRATION FOR EMPLOYEES SUBJECT TO COMPULSORY SOCIAL INSURANCE FROM JULY 1, 2026

As of July 1, 2026, labor registration procedures officially apply to employees who are subject to compulsory social insurance, in accordance with Decree No. 318/2025/ND-CP and Decision No. 645/QD-BNV. This marks an important milestone in labor market management, as labor registration is carried out simultaneously with and integrated into the social insurance registration dossier submitted by the employer.

1. What is labor registration?

Current legislation does not provide a separate definition of “labor registration.” However, based on the 2025 Law on Employment and Decree No. 318/2025/ND-CP, labor registration may be understood as the declaration, collection, updating, and management of information concerning employees in the labor database, serving the purposes of state management of labor and the labor market.

2. What information is included in labor registration?

Pursuant to Article 4 of Decree No. 318/2025/ND-CP, labor registration information includes:

1. Basic information about employees, including: full name at birth; personal identification number; date of birth; gender; ethnicity; current place of residence (permanent or temporary residence).

2. Information on general education, vocational education, higher education, occupational skills certificates, and other certificates, including:

a) Highest level of general education attained;

b) Level and field of training attained through vocational education and higher education;

c) National occupational skills certificates obtained;

d) Other certificates.

3. Information on employment status and employment needs, including:

a) Information on current employment, including position, occupational title, occupation, type of employment contract, and workplace;

b) Information on the employer, including employer’s name; identification number; type of entity; head office address; and economic sector;

c) Information on unemployment status, including period of unemployment and reasons for unemployment;

d) Information on employment needs, meaning information concerning the desired employment, including occupation, type of employment contract, salary and benefits, and workplace.

4. Information on social insurance and unemployment insurance, including:

a) Information on participation in and payment of social insurance and unemployment insurance, including social insurance number, type of participation, and type of social insurance;

b) Information on receipt of social insurance and unemployment insurance benefits, including the type of benefit and period of entitlement.

5. Information on specific characteristics, including:

a) Information concerning persons with disabilities;

b) Information concerning persons belonging to poor households, near-poor households, or households whose land has been recovered;

c) Information concerning relatives of persons with meritorious services to the revolution;

d) Information concerning persons who have completed military service or service in the People’s Public Security forces.

Note: Article 4 of Decree No. 318/2025/ND-CP provides for the overall categories of labor registration information. However, for employees subject to compulsory social insurance, the labor registration dossier is the social insurance registration declaration, supplemented with information on current employment and the employer as prescribed in Points a and b, Clause 3, Article 4 of the Decree.

3. Subjects required to carry out labor registration

Employees subject to compulsory social insurance under Clause 1, Article 2 of the 2024 Law on Social Insurance, except cadres, civil servants, public employees, and people’s armed forces personnel as prescribed in Clause 4, Article 3 of Decree No. 318/2025/ND-CP, shall carry out labor registration from July 1, 2026.

  • Employees subject to compulsory social insurance: applicable from July 1, 2026.
  • Employees who are employed but are not subject to compulsory social insurance: applicable from January 1, 2027.
  • Unemployed persons, meaning persons who have no employment, are seeking employment, and are ready to work: applicable from January 1, 2027.
  • Cadres, civil servants, public employees, and people’s armed forces personnel are not required to register or adjust labor registration information under Decree No. 318/2025/ND-CP.

4. Procedures for labor registration for employees subject to compulsory social insurance

4.1. Procedures

Step 1: The employee provides the employer with the relevant information in the social insurance registration declaration prescribed in Clause 1, Article 5 of Decree No. 318/2025/ND-CP and is responsible for the accuracy of such information.

Step 2: The employer registers the employee’s labor registration information when submitting the dossier for registration or adjustment of social insurance participation information in accordance with the Law on Social Insurance and its guiding documents.

Step 3: After being received and processed by the social insurance authority, the employee’s labor registration information is synchronized and shared with the labor database.

4.2. Dossier components and quantity

Dossier: A social insurance registration declaration supplemented with the following information:

  • Information on current employment, including position, occupational title, occupation, type of employment contract, and workplace;
  • Information on the employer, including employer’s name; identification number; type of entity; head office address; and economic sector.

Number of dossiers: 01 set.

4.3. Processing time

05 working days.

4.4. Competent authority

Vietnam Social Security.

4.5. Fees and charges

No fees or charges are imposed.

4.6. Requirements and conditions

Employees subject to compulsory social insurance who register for social insurance shall carry out labor registration simultaneously with their social insurance registration.

Implementation date: From July 1, 2026.

5. Cases requiring adjustment of labor registration information

Adjustment of labor registration information means a change to one or more of the following:

  • Information on position, occupational title, occupation, type of employment contract, or workplace;
  • Information on the employer, including employer’s name; identification number; type of entity; head office address; and economic sector;
  • A change in status from employed to unemployed;
  • A change from being employed or unemployed to not participating in economic activities (having no ability or no need to work).

For employees subject to compulsory social insurance, adjustment of labor registration information is carried out through the social insurance dossier from July 1, 2026 when there is a change in position, occupational title, occupation, type of employment contract, or workplace.

6. Procedures for adjusting labor registration information for employees subject to compulsory social insurance

6.1. Procedures

Step 1: The employee provides the employer with the relevant information in the social insurance registration declaration prescribed in Clause 1, Article 5 of Decree No. 318/2025/ND-CP and is responsible for the accuracy of such information.

Step 2: The employer adjusts the employee’s labor registration information when submitting the dossier for adjustment of social insurance participation information in accordance with the Law on Social Insurance and its guiding documents.

Step 3: After being received and processed by the social insurance authority, the adjusted labor registration information is synchronized and shared with the labor database.

6.2. Dossier components and quantity

Dossier: A social insurance registration declaration supplemented with the following information:

  • Information on current employment, including position, occupational title, occupation, type of employment contract, and workplace;
  • Information on the employer, including employer’s name; identification number; type of entity; head office address; and economic sector.

Number of dossiers: 01 set.

6.3. Processing time

05 working days.

6.4. Competent authority

Vietnam Social Security.

6.5. Fees and charges

No fees or charges are imposed.

6.6. Requirements and conditions

Employees subject to compulsory social insurance who change their labor registration information as prescribed at Point a, Clause 1, Article 7 of Decree No. 318/2025/ND-CP, including position, occupational title, occupation, type of employment contract, or workplace, shall carry out the relevant adjustment.

Implementation date: From July 1, 2026.

7. Important notes

The employee provides/declares the information and is responsible for its accuracy; the employer is responsible for registering the information when submitting the social insurance dossier.

The employer is responsible for collecting, declaring, and providing complete, accurate, and timely information about employees upon recruitment, changes to, or termination of the employment relationship, while ensuring the truthfulness and accuracy of the information provided.

7.2. Method of dossier submission

For employees subject to compulsory social insurance, labor registration is integrated into the social insurance registration dossier. Accordingly, no separate labor registration dossier is required in addition to the social insurance registration dossier.
