The 2020 Investment Law and Decree No. 29/2021/ND-CP require foreign-invested enterprises operating investment projects in Vietnam to submit periodic investment reports, including:
- Investment supervision and evaluation reports.
- Periodic investment activity reports.
1. For Semi-Annual and Annual Investment Supervision and Evaluation Reports
The requirement to submit this report occurs twice a year: mid-year and end-of-year.
Deadlines:
- Semi-annual reports: Submit by July 10 of the reporting year.
- Annual reports: Submit by February 10 of the following year.
- Submission method: Direct submission to the investment registration authority.
2. For Quarterly and Annual Investment Activity Reports
These reports provide information on project implementation, including capital invested, business performance, labor data, state budget contributions, and metrics on environmental and technological development.
Deadlines:
- Quarterly reports: Submit by the 10th day of the first month of the following quarter (e.g., Q3 report for 2024 is due by October 10, 2024); and,
- Annual reports: Submit by March 31 of the following year.
3. Submission Method
- According to Article 104 of Decree 31/2021/ND-CP, these reports must be submitted online via the National Investment Information System.
- Enterprises are required to register an account and use the templates provided on the system.
4. Penalties for Failure to Submit Reports on Time
According to Article 15 of Decree 122/2021/ND-CP, foreign-invested enterprises that fail to comply with investment reporting requirements in Vietnam may face fines as follows:
- Late or incomplete submission of supervision and evaluation reports: Fines range from VND 20,000,000 to VND 30,000,000.
- Late or omitted submission of investment activity reports: Fines range from VND 30,000,000 to VND 50,000,000.
