Precedent No. 01/2016 on a murder case was adopted and published by the Supreme People’s Court on April 6, 2016, under Decision No. 220.

In a case of an accomplice, if it can be proven that the subjective consciousness of the mastermind is to only hire another person to cause injury to the victim without the intention of depriving them of their life ( the instigators only asks to cause injury to the victim’s legs and arms without requiring an attack on important parts of the body that are likely to lead to death); the partitioners has also compiled with the requirements of the instigators; if the victim’s death is beyond the subjective consciousness of the mastermind, bear criminal liability of the crime “ intentionally causing injury” with the framing circumstance of “ causing injury leading to death”.
