Theo \u0111\u00f3, doanh nghi\u1ec7p c\u1ea7n th\u1ef1c hi\u1ec7n k\u00ea khai v\u00e0 n\u1ed9p <em>c\u00e1c lo\u1ea1i thu\u1ebf ph\u00e1t sinh \u0111\u1ebfn th\u1eddi \u0111i\u1ec3m gi\u1ea3i th\u1ec3<\/em>, trong \u0111\u00f3 bao g\u1ed3m thu\u1ebf thu nh\u1eadp doanh nghi\u1ec7p, thu\u1ebf gi\u00e1 tr\u1ecb gia t\u0103ng, thu\u1ebf thu nh\u1eadp c\u00e1 nh\u00e2n (n\u1ebfu c\u00f3) v\u00e0 c\u00e1c ngh\u0129a v\u1ee5 thu\u1ebf kh\u00e1c theo quy \u0111\u1ecbnh ph\u00e1p lu\u1eadt Vi\u1ec7t Nam hi\u1ec7n h\u00e0nh.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Vi\u1ec7c quy\u1ebft to\u00e1n thu\u1ebf l\u00e0 th\u1ee7 t\u1ee5c b\u1eaft bu\u1ed9c v\u00e0 \u0111\u01b0\u1ee3c ti\u1ebfn h\u00e0nh trong th\u1eddi h\u1ea1n lu\u1eadt \u0111\u1ecbnh t\u1eeb ng\u00e0y ban h\u00e0nh quy\u1ebft \u0111\u1ecbnh gi\u1ea3i th\u1ec3. C\u1ee5 th\u1ec3, doanh nghi\u1ec7p c\u00f3 tr\u00e1ch nhi\u1ec7m l\u1eadp v\u00e0 n\u1ed9p h\u1ed3 s\u01a1 quy\u1ebft to\u00e1n thu\u1ebf cho c\u01a1 quan thu\u1ebf qu\u1ea3n l\u00fd tr\u1ef1c ti\u1ebfp trong v\u00f2ng <strong>45 ng\u00e0y k\u1ec3 t\u1eeb ng\u00e0y quy\u1ebft \u0111\u1ecbnh gi\u1ea3i th\u1ec3<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>C\u01a1 s\u1edf ph\u00e1p l\u00fd: Kho\u1ea3n 4 \u0110i\u1ec1u 44 Lu\u1eadt Qu\u1ea3n l\u00fd thu\u1ebf 2019<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-2-quy-trinh-hoan-t\u1ea5t-quy\u1ebft-toan-thu\u1ebf-khi-gi\u1ea3i-th\u1ec3\"><strong>2. Quy tr\u00ecnh ho\u00e0n t\u1ea5t quy\u1ebft to\u00e1n thu\u1ebf khi gi\u1ea3i th\u1ec3<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Quy tr\u00ecnh quy\u1ebft to\u00e1n thu\u1ebf c\u00f3 t\u00ednh ph\u00e1p l\u00fd quan tr\u1ecdng trong to\u00e0n b\u1ed9 th\u1ee7 t\u1ee5c gi\u1ea3i th\u1ec3. C\u00e1c b\u01b0\u1edbc c\u01a1 b\u1ea3n nh\u01b0 sau:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>a. L\u1eadp v\u00e0 n\u1ed9p h\u1ed3 s\u01a1 quy\u1ebft to\u00e1n thu\u1ebf<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ngay sau khi quy\u1ebft \u0111\u1ecbnh gi\u1ea3i th\u1ec3 \u0111\u01b0\u1ee3c th\u00f4ng qua, doanh nghi\u1ec7p ph\u1ea3i <strong>l\u1eadp v\u00e0 n\u1ed9p h\u1ed3 s\u01a1 quy\u1ebft to\u00e1n thu\u1ebf<\/strong> \u0111\u1ebfn c\u01a1 quan thu\u1ebf qu\u1ea3n l\u00fd tr\u1ef1c ti\u1ebfp, bao g\u1ed3m:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>T\u1edd khai quy\u1ebft to\u00e1n c\u00e1c kho\u1ea3n thu\u1ebf (nh\u01b0 thu\u1ebf thu nh\u1eadp doanh nghi\u1ec7p, thu\u1ebf thu nh\u1eadp c\u00e1 nh\u00e2n, thu\u1ebf VAT);<br><\/li>\n\n\n\n<li>B\u00e1o c\u00e1o t\u00e0i ch\u00ednh \u0111\u1ebfn th\u1eddi \u0111i\u1ec3m gi\u1ea3i th\u1ec3;<br><\/li>\n\n\n\n<li>B\u00e1o c\u00e1o thu\u1ebf th\u00e1ng\/qu\u00fd cu\u1ed1i c\u00f9ng;<br><\/li>\n\n\n\n<li>C\u00e1c ch\u1ee9ng t\u1eeb li\u00ean quan \u0111\u1ebfn ho\u1ea1t \u0111\u1ed9ng kinh doanh v\u00e0 thu\u1ebf.\u00a0<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">C\u01a1 quan thu\u1ebf s\u1ebd ki\u1ec3m tra h\u1ed3 s\u01a1 quy\u1ebft to\u00e1n thu\u1ebf v\u00e0 l\u00e0m vi\u1ec7c v\u1edbi doanh nghi\u1ec7p \u0111\u1ec3 x\u1eed l\u00fd c\u00e1c kho\u1ea3n thu\u1ebf c\u00f2n thi\u1ebfu, ti\u1ec1n ch\u1eadm n\u1ed9p v\u00e0 c\u00e1c kho\u1ea3n ph\u1ea1t n\u1ebfu c\u00f3.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>b. X\u1eed l\u00fd c\u00e1c ngh\u0129a v\u1ee5 li\u00ean quan tr\u01b0\u1edbc khi ch\u1ea5m d\u1ee9t m\u00e3 s\u1ed1 thu\u1ebf<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Trong qu\u00e1 tr\u00ecnh quy\u1ebft to\u00e1n, doanh nghi\u1ec7p c\u1ea7n x\u1eed l\u00fd nhi\u1ec1u ngh\u0129a v\u1ee5 ph\u1ee5 tr\u1ee3 \u0111\u1ec3 c\u01a1 quan thu\u1ebf x\u00e1c nh\u1eadn ho\u00e0n th\u00e0nh quy\u1ebft to\u00e1n:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Thanh l\u00fd t\u00e0i s\u1ea3n c\u1ed1 \u0111\u1ecbnh v\u00e0 c\u00e1c h\u1ee3p \u0111\u1ed3ng lao \u0111\u1ed9ng;<br><\/li>\n\n\n\n<li>B\u00e1o gi\u1ea3m lao \u0111\u1ed9ng v\u00e0 ch\u1ed1t s\u1ed5 b\u1ea3o hi\u1ec3m x\u00e3 h\u1ed9i;<br><\/li>\n\n\n\n<li>H\u1ee7y h\u00f3a \u0111\u01a1n ch\u01b0a s\u1eed d\u1ee5ng n\u1ebfu c\u00f2n t\u1ed3n t\u1ea1i;<br><\/li>\n\n\n\n<li>\u0110\u00f3ng t\u00e0i kho\u1ea3n ng\u00e2n h\u00e0ng \u0111\u1ee9ng t\u00ean doanh nghi\u1ec7p.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Nh\u1eefng b\u01b0\u1edbc n\u00e0y c\u00f3 \u00fd ngh\u0129a ph\u00e1p l\u00fd quan tr\u1ecdng trong vi\u1ec7c x\u00e1c \u0111\u1ecbnh doanh nghi\u1ec7p <strong>kh\u00f4ng c\u00f2n ph\u00e1t sinh ngh\u0129a v\u1ee5 thu\u1ebf ho\u1eb7c t\u00e0i ch\u00ednh kh\u00e1c v\u1edbi Nh\u00e0 n\u01b0\u1edbc<\/strong>, gi\u00fap c\u01a1 quan thu\u1ebf s\u1edbm ban h\u00e0nh x\u00e1c nh\u1eadn ho\u00e0n th\u00e0nh ngh\u0129a v\u1ee5 thu\u1ebf.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>c. Nh\u1eadn x\u00e1c nh\u1eadn ho\u00e0n th\u00e0nh ngh\u0129a v\u1ee5 thu\u1ebf<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sau khi h\u1ed3 s\u01a1 quy\u1ebft to\u00e1n \u0111\u1ea7y \u0111\u1ee7 v\u00e0 m\u1ecdi kho\u1ea3n thu\u1ebf \u0111\u01b0\u1ee3c x\u1eed l\u00fd, c\u01a1 quan thu\u1ebf s\u1ebd <strong>ban h\u00e0nh Th\u00f4ng b\u00e1o x\u00e1c nh\u1eadn doanh nghi\u1ec7p \u0111\u00e3 ho\u00e0n t\u1ea5t ngh\u0129a v\u1ee5 thu\u1ebf<\/strong>. \u0110\u00e2y l\u00e0 m\u1ed9t trong nh\u1eefng t\u00e0i li\u1ec7u ph\u00e1p l\u00fd b\u1eaft bu\u1ed9c tr\u01b0\u1edbc khi n\u1ed9p h\u1ed3 s\u01a1 ti\u1ebfp theo cho Ph\u00f2ng \u0110\u0103ng k\u00fd Kinh doanh \u0111\u1ec3 ho\u00e0n t\u1ea5t th\u1ee7 t\u1ee5c gi\u1ea3i th\u1ec3.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-3-l\u01b0u-y-phap-ly-va-r\u1ee7i-ro-n\u1ebfu-khong-hoan-t\u1ea5t-quy\u1ebft-toan-thu\u1ebf\"><strong>3. L\u01b0u \u00fd ph\u00e1p l\u00fd v\u00e0 r\u1ee7i ro n\u1ebfu kh\u00f4ng ho\u00e0n t\u1ea5t quy\u1ebft to\u00e1n thu\u1ebf<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Vi\u1ec7c quy\u1ebft to\u00e1n thu\u1ebf kh\u00f4ng ch\u1ec9 l\u00e0 th\u1ee7 t\u1ee5c h\u00e0nh ch\u00ednh &#8211; n\u00f3 c\u00f2n mang t\u00ednh ph\u00e1p l\u00fd then ch\u1ed1t, b\u1edfi n\u1ebfu doanh nghi\u1ec7p:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Kh\u00f4ng n\u1ed9p h\u1ed3 s\u01a1 quy\u1ebft to\u00e1n thu\u1ebf \u0111\u00fang th\u1eddi h\u1ea1n (45 ng\u00e0y t\u1eeb ng\u00e0y ra quy\u1ebft \u0111\u1ecbnh gi\u1ea3i th\u1ec3);<br><\/li>\n\n\n\n<li>Ho\u1eb7c c\u00f3 ngh\u0129a v\u1ee5 thu\u1ebf c\u00f2n t\u1ed3n \u0111\u1ecdng m\u00e0 kh\u00f4ng \u0111\u01b0\u1ee3c gi\u1ea3i quy\u1ebft;<br><\/li>\n\n\n\n<li>Ho\u1eb7c h\u1ed3 s\u01a1 quy\u1ebft to\u00e1n thi\u1ebfu ch\u1ee9ng t\u1eeb, b\u00e1o c\u00e1o t\u00e0i ch\u00ednh, sau \u0111\u1ed1i chi\u1ebfu c\u01a1 quan thu\u1ebf y\u00eau c\u1ea7u b\u1ed5 sung <strong>th\u00ec h\u1ed3 s\u01a1 gi\u1ea3i th\u1ec3 c\u00f3 th\u1ec3 b\u1ecb tr\u1ea3 l\u1ea1i, k\u00e9o d\u00e0i th\u1eddi gian gi\u1ea3i th\u1ec3 v\u00e0 ph\u00e1t sinh h\u1eadu qu\u1ea3 ph\u00e1p l\u00fd<\/strong> nh\u01b0: b\u1ecb x\u1eed ph\u1ea1t ti\u1ec1n ch\u1eadm n\u1ed9p, b\u1ecb gi\u1eef l\u1ea1i m\u00e3 s\u1ed1 thu\u1ebf, ho\u1eb7c trong m\u1ed9t s\u1ed1 tr\u01b0\u1eddng h\u1ee3p b\u1ecb c\u01b0\u1ee1ng ch\u1ebf thu h\u1ed3i n\u1ee3 thu\u1ebf theo quy \u0111\u1ecbnh.\u00a0<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-4-k\u1ebft-lu\u1eadn-va-khuy\u1ebfn-ngh\u1ecb-phap-ly\"><strong>4.\u00a0 K\u1ebft lu\u1eadn v\u00e0 khuy\u1ebfn ngh\u1ecb ph\u00e1p l\u00fd<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Quy tr\u00ecnh gi\u1ea3i th\u1ec3 doanh nghi\u1ec7p t\u1ea1i Vi\u1ec7t Nam t\u00edch h\u1ee3p <strong>nhi\u1ec1u b\u01b0\u1edbc ph\u00e1p l\u00fd ph\u1ee9c t\u1ea1p<\/strong>, trong \u0111\u00f3 <em>quy\u1ebft to\u00e1n thu\u1ebf v\u00e0 ho\u00e0n t\u1ea5t ngh\u0129a v\u1ee5 thu\u1ebf l\u00e0 b\u01b0\u1edbc then ch\u1ed1t nh\u1ea5t<\/em>.
