C\u00e1ch x\u00e1c \u0111\u1ecbnh t\u00ecnh tr\u1ea1ng c\u01b0 tr\u00fa<\/strong><\/h2>\n\n\n\n<p><em>CSPL: Kho\u1ea3n 1 v\u00e0 kho\u1ea3n 2 \u0110i\u1ec1u 1 Th\u00f4ng t\u01b0 111\/2013\/TT-BTC (s\u1eeda \u0111\u1ed5i, b\u1ed5 sung b\u1edfi \u0110i\u1ec1u 2 Th\u00f4ng t\u01b0 119\/2014\/TT-BTC), \u0110i\u1ec1u 2 D\u1ef1 th\u1ea3o Lu\u1eadt Thu\u1ebf thu nh\u1eadp c\u00e1 nh\u00e2n.<\/em><\/p>\n\n\n\n<p>C\u00e1 nh\u00e2n \u0111\u01b0\u1ee3c coi l\u00e0 c\u01b0 tr\u00fa Vi\u1ec7t Nam n\u1ebfu:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>C\u00f3 m\u1eb7t t\u1ea1i Vi\u1ec7t Nam t\u1eeb 183 ng\u00e0y tr\u1edf l\u00ean t\u00ednh trong m\u1ed9t n\u0103m d\u01b0\u01a1ng l\u1ecbch ho\u1eb7c trong 12 th\u00e1ng li\u00ean t\u1ee5c k\u1ec3 t\u1eeb ng\u00e0y \u0111\u1ea7u ti\u00ean c\u00f3 m\u1eb7t t\u1ea1i Vi\u1ec7t Nam.<\/li>\n\n\n\n<li>Ho\u1eb7c c\u00f3 n\u01a1i \u1edf th\u01b0\u1eddng xuy\u00ean t\u1ea1i Vi\u1ec7t Nam thu\u1ed9c m\u1ed9t trong hai tr\u01b0\u1eddng h\u1ee3p sau:\n<ul class=\"wp-block-list\">\n<li><strong><em>(i) Theo ph\u00e1p lu\u1eadt c\u01b0 tr\u00fa:<\/em><\/strong> C\u00e1 nh\u00e2n c\u00f3 n\u01a1i \u1edf th\u01b0\u1eddng tr\u00fa (th\u1ec3 hi\u1ec7n tr\u00ean Th\u1ebb th\u01b0\u1eddng tr\u00fa) ho\u1eb7c n\u01a1i \u1edf t\u1ea1m tr\u00fa (ghi tr\u00ean Th\u1ebb t\u1ea1m tr\u00fa do B\u1ed9 C\u00f4ng an c\u1ea5p).<\/li>\n\n\n\n<li><strong><em>(ii) Theo ph\u00e1p lu\u1eadt nh\u00e0 \u1edf: <\/em><\/strong>C\u00e1 nh\u00e2n c\u00f3 nh\u00e0 thu\u00ea \u0111\u1ec3 \u1edf t\u1eeb 183 ng\u00e0y tr\u1edf l\u00ean trong n\u0103m t\u00ednh thu\u1ebf \u0111\u01b0\u1ee3c x\u00e1c \u0111\u1ecbnh l\u00e0 c\u01b0 tr\u00fa, k\u1ec3 c\u1ea3 thu\u00ea \u1edf nhi\u1ec1u n\u01a1i v\u00e0 kh\u00f4ng ph\u00e2n bi\u1ec7t t\u1ef1 thu\u00ea hay do doanh nghi\u1ec7p thu\u00ea h\u1ed9.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-primary-color has-text-color has-link-color wp-elements-cfea6f8dbba652f43443239d346148a8\" id=\"h-2-cac-kho\u1ea3n-thu-nh\u1eadp-ch\u1ecbu-thu\u1ebf-thu-nh\u1eadp-ca-nhan-ma-chuyen-gia-n\u01b0\u1edbc-ngoai-c\u1ea7n-dong\"><strong>2. C\u00e1c kho\u1ea3n thu nh\u1eadp ch\u1ecbu thu\u1ebf thu nh\u1eadp c\u00e1 nh\u00e2n m\u00e0 chuy\u00ean gia n\u01b0\u1edbc ngo\u00e0i c\u1ea7n \u0111\u00f3ng<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading has-secondary-color has-text-color has-link-color wp-elements-e28720392251808ced03b0e3096ed8ae\" id=\"h-2-1-thu-nh\u1eadp-t\u1eeb-ti\u1ec1n-l\u01b0\u01a1ng-ti\u1ec1n-cong\"><strong><em>2.1. Thu nh\u1eadp t\u1eeb ti\u1ec1n l\u01b0\u01a1ng, ti\u1ec1n c\u00f4ng<\/em><\/strong><\/h3>\n\n\n\n<p><em>CSPL: \u0110i\u1ec1u 10, \u0110i\u1ec1u 22 D\u1ef1 th\u1ea3o Lu\u1eadt Thu\u1ebf thu nh\u1eadp c\u00e1 nh\u00e2n.<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u0110\u1ed1i v\u1edbi c\u00e1 nh\u00e2n c\u01b0 tr\u00fa, thu nh\u1eadp ch\u1ecbu thu\u1ebf l\u00e0 thu nh\u1eadp ph\u00e1t sinh trong v\u00e0 ngo\u00e0i l\u00e3nh th\u1ed5 Vi\u1ec7t Nam, \u00e1p d\u1ee5ng bi\u1ec3u thu\u1ebf \u0111\u01b0\u1ee3c r\u00fat g\u1ecdn c\u00f2n 5 b\u1eadc, v\u1edbi thu\u1ebf su\u1ea5t t\u1eeb 5% \u0111\u1ebfn 35%, thay cho 7 b\u1eadc hi\u1ec7n h\u00e0nh \u0111\u1ed1i v\u1edbi thu nh\u1eadp t\u1eeb ti\u1ec1n l\u01b0\u01a1ng, ti\u1ec1n c\u00f4ng. C\u1ee5 th\u1ec3, B\u1ed9 T\u00e0i ch\u00ednh \u0111ang \u0111\u1ec1 xu\u1ea5t 2 ph\u01b0\u01a1ng \u00e1n r\u00fat g\u1ecdn bi\u1ec3u thu\u1ebf nh\u01b0 sau:\n<ul class=\"wp-block-list\">\n<li><strong><em>Ph\u01b0\u01a1ng \u00e1n 1:<\/em><\/strong> Bi\u1ec3u thu\u1ebf g\u1ed3m 5 b\u1eadc, v\u1edbi kho\u1ea3ng c\u00e1ch gi\u1eefa c\u00e1c b\u1eadc l\u1ea7n l\u01b0\u1ee3t l\u00e0 10 &#8211; 20 &#8211; 20 &#8211; 30 tri\u1ec7u \u0111\u1ed3ng, b\u1eadc cao nh\u1ea5t 35% \u00e1p d\u1ee5ng cho ph\u1ea7n thu nh\u1eadp t\u00ednh thu\u1ebf tr\u00ean 80 tri\u1ec7u \u0111\u1ed3ng\/th\u00e1ng.<\/li>\n\n\n\n<li><strong><em>Ph\u01b0\u01a1ng \u00e1n 2: <\/em><\/strong>Bi\u1ec3u thu\u1ebf g\u1ed3m 5 b\u1eadc, v\u1edbi kho\u1ea3ng c\u00e1ch gi\u1eefa c\u00e1c b\u1eadc t\u0103ng d\u1ea7n l\u00e0 10 &#8211; 20 &#8211; 30 &#8211; 40 tri\u1ec7u \u0111\u1ed3ng, b\u1eadc cao nh\u1ea5t 35% \u00e1p d\u1ee5ng cho ph\u1ea7n thu nh\u1eadp t\u00ednh thu\u1ebf tr\u00ean 100 tri\u1ec7u \u0111\u1ed3ng\/th\u00e1ng.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>\u0110\u1ed1i v\u1edbi c\u00e1 nh\u00e2n kh\u00f4ng c\u01b0 tr\u00fa, thu nh\u1eadp ch\u1ecbu thu\u1ebf l\u00e0 thu nh\u1eadp ph\u00e1t sinh t\u1ea1i Vi\u1ec7t Nam, \u00e1p d\u1ee5ng thu\u1ebf su\u1ea5t c\u1ed1 \u0111\u1ecbnh 20% \u0111\u1ed1i v\u1edbi thu nh\u1eadp t\u1eeb ti\u1ec1n l\u01b0\u01a1ng, ti\u1ec1n c\u00f4ng.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-secondary-color has-text-color has-link-color wp-elements-68fe9389a9c5201e6836436aa7794d7b\" id=\"h-2-2-thu-nh\u1eadp-t\u1eeb-h\u1ee3p-d\u1ed3ng-d\u1ecbch-v\u1ee5-t\u01b0-v\u1ea5n-lam-vi\u1ec7c-t\u1ef1-do\"><strong><em>2.2. Thu nh\u1eadp t\u1eeb h\u1ee3p \u0111\u1ed3ng d\u1ecbch v\u1ee5, t\u01b0 v\u1ea5n, l\u00e0m vi\u1ec7c t\u1ef1 do<\/em><\/strong><\/h3>\n\n\n\n<p><em>CSPL: \u0110i\u1ec3m i kho\u1ea3n 1 \u0110i\u1ec1u 25 Th\u00f4ng t\u01b0 111\/2013\/TT-BTC.<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>C\u00e1 nh\u00e2n c\u01b0 tr\u00fa kh\u00f4ng k\u00fd h\u1ee3p \u0111\u1ed3ng lao \u0111\u1ed9ng ho\u1eb7c k\u00fd h\u1ee3p \u0111\u1ed3ng lao \u0111\u1ed9ng d\u01b0\u1edbi 03 th\u00e1ng m\u00e0 c\u00f3 t\u1ed5ng m\u1ee9c tr\u1ea3 thu nh\u1eadp t\u1eeb 2.000.000 \u0111\u1ed3ng\/l\u1ea7n tr\u1edf l\u00ean th\u00ec ph\u1ea3i \u0111\u00f3ng thu\u1ebf v\u1edbi m\u1ee9c 10% tr\u00ean ti\u1ec1n th\u00f9 lao.<\/li>\n<\/ul>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large is-resized\"><img fetchpriority=\"high\" decoding=\"async\" width=\"721\" height=\"1024\" src=\"https:\/\/www.dnp-law.com\/vi\/wp-content\/uploads\/2025\/11\/196-721x1024.png\" alt=\"\" class=\"wp-image-6266\" style=\"width:407px;height:auto\" srcset=\"https:\/\/www.dnp-law.com\/vi\/wp-content\/uploads\/2025\/11\/196-721x1024.png 721w, https:\/\/www.dnp-law.com\/vi\/wp-content\/uploads\/2025\/11\/196-211x300.png 211w, https:\/\/www.dnp-law.com\/vi\/wp-content\/uploads\/2025\/11\/196-768x1090.png 768w, https:\/\/www.dnp-law.com\/vi\/wp-content\/uploads\/2025\/11\/196-1082x1536.png 1082w, https:\/\/www.dnp-law.com\/vi\/wp-content\/uploads\/2025\/11\/196.png 1409w\" sizes=\"(max-width: 721px) 100vw, 721px\" \/><\/figure>\n<\/div>\n\n\n<h3 class=\"wp-block-heading has-secondary-color has-text-color has-link-color wp-elements-7d49740ed73a618780e0393c5cc136f7\" id=\"h-2-3-thu-nh\u1eadp-t\u1eeb-chuy\u1ec3n-nh\u01b0\u1ee3ng-v\u1ed1n\"><strong><em>2.3. Thu nh\u1eadp t\u1eeb chuy\u1ec3n nh\u01b0\u1ee3ng v\u1ed1n<\/em><\/strong><\/h3>\n\n\n\n<p><em>CSPL: Kho\u1ea3n 1 \u0110i\u1ec1u 11 Th\u00f4ng t\u01b0 111\/2013\/TT-BTC.<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>C\u00e1ch t\u00ednh thu\u1ebf: Thu nh\u1eadp t\u00ednh thu\u1ebf \u00d7 Thu\u1ebf su\u1ea5t 20%<\/li>\n<\/ul>\n\n\n\n<p>Trong \u0111\u00f3: Thu nh\u1eadp t\u00ednh thu\u1ebf = Gi\u00e1 chuy\u1ec3n nh\u01b0\u1ee3ng &#8211; Gi\u00e1 mua &#8211; C\u00e1c chi ph\u00ed h\u1ee3p l\u00fd li\u00ean quan.<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-secondary-color has-text-color has-link-color wp-elements-deb2cdbc12b3b81026d87e9b64a43218\" id=\"h-2-4-thu-nh\u1eadp-t\u1eeb-chuy\u1ec3n-nh\u01b0\u1ee3ng-b\u1ea5t-d\u1ed9ng-s\u1ea3n\"><strong><em>2.4. Thu nh\u1eadp t\u1eeb chuy\u1ec3n nh\u01b0\u1ee3ng b\u1ea5t \u0111\u1ed9ng s\u1ea3n<\/em><\/strong><\/h3>\n\n\n\n<p><em>CSPL: \u0110i\u1ec1u 12 Th\u00f4ng t\u01b0 111\/2013\/TT-BTC.<\/em><\/p>\n\n\n\n<p>C\u00f3 2 c\u00e1ch t\u00ednh t\u00f9y v\u00e0o kh\u1ea3 n\u0103ng x\u00e1c \u0111\u1ecbnh chi ph\u00ed:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>N\u1ebfu x\u00e1c \u0111\u1ecbnh \u0111\u01b0\u1ee3c thu nh\u1eadp t\u00ednh thu\u1ebf, chi ph\u00ed li\u00ean quan: Thu\u1ebf ph\u1ea3i n\u1ed9p = Thu nh\u1eadp t\u00ednh thu\u1ebf \u00d7 25%<\/li>\n\n\n\n<li>N\u1ebfu kh\u00f4ng x\u00e1c \u0111\u1ecbnh \u0111\u01b0\u1ee3c gi\u00e1 v\u1ed1n ho\u1eb7c kh\u00f4ng c\u00f3 h\u1ed3 s\u01a1 ch\u1ee9ng minh chi ph\u00ed, gi\u00e1 mua,&#8230;): Thu\u1ebf ph\u1ea3i n\u1ed9p = Gi\u00e1 chuy\u1ec3n nh\u01b0\u1ee3ng \u00d7 2%<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-secondary-color has-text-color has-link-color wp-elements-34943fe3bca3570ded27f0311bc96b9c\" id=\"h-2-5-thu-nh\u1eadp-t\u1eeb-b\u1ea3n-quy\u1ec1n-nh\u01b0\u1ee3ng-quy\u1ec1n-th\u01b0\u01a1ng-m\u1ea1i\"><strong><em>2.5. Thu nh\u1eadp t\u1eeb b\u1ea3n quy\u1ec1n, nh\u01b0\u1ee3ng quy\u1ec1n th\u01b0\u01a1ng m\u1ea1i<\/em><\/strong><\/h3>\n\n\n\n<p><em>CSPL: \u0110i\u1ec1u 13, 14 Th\u00f4ng t\u01b0 111\/2013\/TT-BTC.<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Thu\u1ebf su\u1ea5t thu\u1ebf TNCN \u0111\u1ed1i v\u1edbi thu nh\u1eadp t\u1eeb b\u1ea3n quy\u1ec1n, nh\u01b0\u1ee3ng quy\u1ec1n th\u01b0\u01a1ng m\u1ea1i l\u00e0 5%.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-primary-color has-text-color has-link-color wp-elements-f1083d4d950c651e88c5071050d3faac\" id=\"h-3-trach-nhi\u1ec7m-kh\u1ea5u-tr\u1eeb-ke-khai-n\u1ed9p-thu\u1ebf\"><strong>3.
