C\u00e1c lo\u1ea1i thu\u1ebf c\u00f3 th\u1ec3 \u00e1p d\u1ee5ng bao g\u1ed3m thu\u1ebf thu nh\u1eadp c\u00e1 nh\u00e2n (TNCN) \u0111\u1ed1i v\u1edbi gi\u00e1o vi\u00ean d\u1ea1y th\u00eam v\u00e0 <a href=\"https:\/\/www.facebook.com\/photo\/?fbid=122146644206498618&amp;set=a.122108153468498618\">thu\u1ebf gi\u00e1 tr\u1ecb gia t\u0103ng (VAT)<\/a> n\u1ebfu ho\u1ea1t \u0111\u1ed9ng mang t\u00ednh ch\u1ea5t kinh doanh d\u1ecbch v\u1ee5. M\u1ee9c thu\u1ebf c\u1ee5 th\u1ec3 ph\u1ee5 thu\u1ed9c v\u00e0o thu nh\u1eadp v\u00e0 ch\u00ednh s\u00e1ch thu\u1ebf hi\u1ec7n h\u00e0nh. Vi\u1ec7c tu\u00e2n th\u1ee7 ngh\u0129a v\u1ee5 thu\u1ebf gi\u00fap ho\u1ea1t \u0111\u1ed9ng d\u1ea1y th\u00eam h\u1ee3p ph\u00e1p v\u00e0 tr\u00e1nh c\u00e1c r\u1ee7i ro ph\u00e1p l\u00fd.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-i-d\u1ed1i-v\u1edbi-h\u1ed9-kinh-doanh\">I. \u0110\u1ed1i v\u1edbi h\u1ed9 kinh doanh<\/h2>\n\n\n\n<p>C\u00f3 hai tr\u01b0\u1eddng h\u1ee3p: H\u1ed9 kinh doanh kho\u00e1n v\u00e0 h\u1ed9 kinh doanh k\u00ea khai<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-1-1-h\u1ed9-kinh-doanh-v\u1edbi-quy-mo-l\u1edbn-h\u1ed9-kinh-doanh-ke-khai\">1.1. H\u1ed9 kinh doanh v\u1edbi quy m\u00f4 l\u1edbn ( H\u1ed9 kinh doanh k\u00ea khai):<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>M\u1ee9c thu\u1ebf su\u1ea5t l\u00e0 2% doanh thu.<\/li>\n\n\n\n<li>Thu\u1ebf TNCN: H\u1ed9 kinh doanh, c\u00e1 nh\u00e2n kinh doanh c\u00f3 doanh thu t\u1eeb ho\u1ea1t \u0111\u1ed9ng s\u1ea3n xu\u1ea5t, kinh doanh trong n\u0103m d\u01b0\u01a1ng l\u1ecbch t\u1eeb 100 tri\u1ec7u \u0111\u1ed3ng tr\u1edf l\u00ean<\/li>\n\n\n\n<li>Kh\u00f4ng ph\u1ea3i \u0111\u00f3ng thu\u1ebf TNCN v\u00e0 thu\u1ebf GTGT \u0111\u1ed1i v\u1edbi doanh thu d\u01b0\u1edbi 100 tri\u1ec7u \u0111\u1ed3ng tr\u1edf xu\u1ed1ng<\/li>\n<\/ul>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>L\u01b0u \u00fd: T\u1eeb 01\/01\/2026, ng\u01b0\u1ee1ng doanh thu n\u1ed9p thu\u1ebf thu nh\u1eadp c\u00e1 nh\u00e2n c\u1ee7a c\u00e1 nh\u00e2n, h\u1ed9 kinh doanh t\u0103ng l\u00ean 200 tri\u1ec7u \u0111\u1ed3ng theo quy \u0111\u1ecbnh t\u1ea1i \u0110i\u1ec1u 5, \u0110i\u1ec1u 17, kho\u1ea3n 2 \u0110i\u1ec1u 18 Lu\u1eadt Thu\u1ebf gi\u00e1 tr\u1ecb gia t\u0103ng 2024.<\/em><\/p>\n<\/blockquote>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large is-resized\"><img fetchpriority=\"high\" decoding=\"async\" width=\"1024\" height=\"1024\" src=\"https:\/\/www.dnp-law.com\/vi\/wp-content\/uploads\/2025\/02\/3-1024x1024.png\" alt=\"\" class=\"wp-image-5387\" style=\"width:582px;height:auto\" srcset=\"https:\/\/www.dnp-law.com\/vi\/wp-content\/uploads\/2025\/02\/3-1024x1024.png 1024w, https:\/\/www.dnp-law.com\/vi\/wp-content\/uploads\/2025\/02\/3-300x300.png 300w, https:\/\/www.dnp-law.com\/vi\/wp-content\/uploads\/2025\/02\/3-150x150.png 150w, https:\/\/www.dnp-law.com\/vi\/wp-content\/uploads\/2025\/02\/3-768x768.png 768w, https:\/\/www.dnp-law.com\/vi\/wp-content\/uploads\/2025\/02\/3.png 1080w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n<\/div>\n\n\n<p class=\"has-text-align-center\"><em>(H\u00ecnh \u1ea3nh \u0111\u01b0\u1ee3c thi\u1ebft k\u1ebf b\u1edfi DNP Viet Nam Law Firm)<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-1-2-h\u1ed9-kinh-doanh-v\u1edbi-quy-mo-nh\u1ecf-h\u1ed9-kinh-doanh-khoan\">1.2. H\u1ed9 kinh doanh v\u1edbi quy m\u00f4 nh\u1ecf ( H\u1ed9 kinh doanh kho\u00e1n):<\/h3>\n\n\n\n<p><br>C\u00e1n b\u1ed9 thu\u1ebf \u1ea5n \u0111\u1ecbnh doanh thu kho\u00e1n, \u0111\u01b0a ra m\u1ee9c thu\u1ebf kho\u00e1n d\u1ef1a tr\u00ean quy m\u00f4 kinh doanh c\u1ee7a h\u1ed9 kinh doanh, doanh thu ch\u1ee7 h\u1ed9 k\u00ea khai ban \u0111\u1ea7u, d\u1ef1a v\u00e0o m\u1ee9c thu\u1ebf c\u1ee7a c\u00e1c h\u1ed9 kinh doanh c\u00f9ng l\u0129nh v\u1ef1c tr\u00ean c\u00f9ng \u0111\u1ecba b\u00e0n.<br><strong><em>\u0110\u1ed1i v\u1edbi l\u1ec7 ph\u00ed m\u00f4n b\u00e0i<br><\/em><\/strong>&#8211; H\u1ed9 kinh doanh d\u1ea1y th\u00eam \u0111\u01b0\u1ee3c mi\u1ec5n l\u1ec7 ph\u00ed m\u00f4n b\u00e0i trong tr\u01b0\u1eddng h\u1ee3p:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>C\u00e1 nh\u00e2n, nh\u00f3m c\u00e1 nh\u00e2n, h\u1ed9 gia \u0111\u00ecnh ho\u1ea1t \u0111\u1ed9ng s\u1ea3n xu\u1ea5t, kinh doanh c\u00f3 doanh thu h\u00e0ng n\u0103m t\u1eeb 100 tri\u1ec7u \u0111\u1ed3ng tr\u1edf xu\u1ed1ng<\/li>\n\n\n\n<li>Mi\u1ec5n l\u1ec7 ph\u00ed trong n\u0103m \u0111\u1ea7u th\u00e0nh l\u1eadp ho\u1eb7c ra ho\u1ea1t \u0111\u1ed9ng s\u1ea3n xu\u1ea5t, kinh doanh (t\u1eeb ng\u00e0y 01\/01 \u0111\u1ebfn ng\u00e0y 31\/12) \u0111\u1ed1i v\u1edbi h\u1ed9 gia \u0111\u00ecnh, c\u00e1 nh\u00e2n, nh\u00f3m c\u00e1 nh\u00e2n l\u1ea7n \u0111\u1ea7u ra ho\u1ea1t \u0111\u1ed9ng s\u1ea3n xu\u1ea5t, kinh doanh.<\/li>\n<\/ul>\n\n\n\n<p><em>Kho\u1ea3n 2 \u0110i\u1ec1u 4 Ngh\u1ecb \u0111\u1ecbnh 139\/2016\/N\u0110-CP v\u00e0 Theo \u0110i\u1ec3m c, Kho\u1ea3n 1, \u0110i\u1ec1u 1 Ngh\u1ecb \u0111\u1ecbnh 22\/2020\/N\u0110-CP th\u00ec m\u1ee9c thu l\u1ec7 ph\u00ed m\u00f4n b\u00e0i \u0111\u1ed1i v\u1edbi h\u1ed9 kinh doanh c\u00e1 th\u1ec3 \u0111\u01b0\u1ee3c t\u00ednh d\u1ef1a theo doanh thu b\u00ecnh qu\u00e2n h\u00e0ng n\u0103m:<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Doanh thu tr\u00ean 500 tri\u1ec7u \u0111\u1ed3ng\/n\u0103m l\u1ec7 ph\u00ed m\u00f4n b\u00e0i 1.000.000 \u0111\u1ed3ng\/n\u0103m;<\/li>\n\n\n\n<li>Doanh thu tr\u00ean 300 \u0111\u1ebfn 500 tri\u1ec7u \u0111\u1ed3ng\/n\u0103m l\u1ec7 ph\u00ed m\u00f4n b\u00e0i 500.000 \u0111\u1ed3ng\/n\u0103m<\/li>\n\n\n\n<li>Doanh thu tr\u00ean 100 \u0111\u1ebfn 300 tri\u1ec7u \u0111\u1ed3ng\/n\u0103m l\u1ec7 ph\u00ed m\u00f4n b\u00e0i 300.000 \u0111\u1ed3ng\/n\u0103m;<\/li>\n\n\n\n<li>Doanh thu t\u1eeb 100 tri\u1ec7u \u0111\u1ed3ng\/n\u0103m tr\u1edf xu\u1ed1ng s\u1ebd \u0111\u01b0\u1ee3c mi\u1ec5n l\u1ec7 ph\u00ed m\u00f4n b\u00e0i<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-ii-d\u1ed1i-v\u1edbi-thanh-l\u1eadp-doanh-nghi\u1ec7p\">II. \u0110\u1ed1i v\u1edbi th\u00e0nh l\u1eadp doanh nghi\u1ec7p<\/h2>\n\n\n\n<p><br><strong>C\u00e1c loai thu\u1ebf ph\u1ea3i n\u1ed9p<br>Thu\u1ebf thu nh\u1eadp doanh nghi\u1ec7p<br><\/strong>Thu\u1ebf thu nh\u1eadp doanh nghi\u1ec7p = Thu nh\u1eadp t\u00ednh thu\u1ebf trong k\u1ef3 x Thu\u1ebf su\u1ea5t<br><em>Trong \u0111\u00f3:<\/em><\/p>\n\n\n\n<p><strong>Thu nh\u1eadp t\u00ednh thu\u1ebf \u0111\u01b0\u1ee3c t\u00ednh nh\u01b0 sau:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Thu nh\u1eadp t\u00ednh thu\u1ebf = Thu nh\u1eadp ch\u1ecbu thu\u1ebf &#8211; Chi ph\u00ed \u0111\u01b0\u1ee3c tr\u1eeb + C\u00e1c kho\u1ea3n thu nh\u1eadp kh\u00e1c<\/li>\n<\/ul>\n\n\n\n<p><strong>Thu\u1ebf su\u1ea5t thu\u1ebf thu nh\u1eadp doanh nghi\u1ec7p: <\/strong><\/p>\n\n\n\n<p><em>C\u0103n c\u1ee9 \u0110i\u1ec1u 10 Ngh\u1ecb \u0111\u1ecbnh 218\/2013\/N\u0110-CP s\u0111 &#8211; bs ngh\u1ecb \u0111\u1ecbnh 57\/2021, doanh nghi\u1ec7p \u0111\u01b0\u1ee3c th\u00e0nh l\u1eadp v\u00e0 ho\u1ea1t \u0111\u1ed9ng theo quy \u0111\u1ecbnh c\u1ee7a ph\u00e1p lu\u1eadt Vi\u1ec7t Nam, c\u00f3 t\u1ed5ng doanh thu n\u0103m kh\u00f4ng qu\u00e1 20 t\u1ef7 \u0111\u1ed3ng \u0111\u01b0\u1ee3c \u00e1p d\u1ee5ng thu\u1ebf su\u1ea5t 20%.<br><\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>T\u1ed5ng doanh thu n\u0103m l\u00e0m c\u0103n c\u1ee9 x\u00e1c \u0111\u1ecbnh doanh nghi\u1ec7p thu\u1ed9c \u0111\u1ed1i t\u01b0\u1ee3ng \u0111\u01b0\u1ee3c \u00e1p d\u1ee5ng thu\u1ebf su\u1ea5t 20% quy \u0111\u1ecbnh t\u1ea1i kho\u1ea3n n\u00e0y l\u00e0 t\u1ed5ng doanh thu b\u00e1n h\u00e0ng h\u00f3a, cung c\u1ea5p d\u1ecbch v\u1ee5 c\u1ee7a doanh nghi\u1ec7p c\u1ee7a n\u0103m tr\u01b0\u1edbc li\u1ec1n k\u1ec1.<\/li>\n\n\n\n<li>Thu nh\u1eadp t\u1eeb th\u1ef1c hi\u1ec7n ho\u1ea1t \u0111\u1ed9ng x\u00e3 h\u1ed9i h\u00f3a trong l\u0129nh v\u1ef1c gi\u00e1o d\u1ee5c &#8211;
