Along with the strong growth of investment flows and the increasing presence of foreign experts and workers in Vietnam, the demand for work permit renewal has become more common than ever. Renewing a work permit not only legalizes the employment of foreign workers but also serves as a legal “shield” for enterprises. However, the procedures in 2025 introduce several new points that require special attention.

1. Application dossier for work permit renewal
Legal basis: Article 27 of Decree 219/2025/ND-CP.
- Written explanation of demand and request for work permit renewal (Form No. 03).
- Valid health certificate (issued within the past 12 months).
- Two color photos (4×6 cm, white background).
- Valid work permit.
- Valid passport.
- Documents proving the form of employment (as prescribed in the Decree).
2. Procedures for work permit renewal
Legal basis: Articles 4 and 28 of Decree 219/2025/ND-CP.
- Submission deadline: At least 10 days and up to 45 days before the work permit expires. If the permit expires without renewal, the worker must apply for a new permit from the beginning.
- Place of submission: Provincial public administrative service center (direct submission, via postal service, online services, or authorized representative).
- Processing time: Within 10 working days from the date of receiving a complete and valid dossier, the Provincial People’s Committee will review and either renew the work permit (Form No. 03) or issue a written refusal stating the reasons.
- In cases stipulated under Clause 4 Article 28 of the Decree, the parties must sign a written labor contract before continuing the employment and provide a copy to the competent authority upon request.

3. Duration of renewed work permit
Legal basis: Article 29 of Decree 219/2025/ND-CP.
- Based on the duration of one of the cases specified in Article 21 of the Decree.
- Each work permit may be renewed only once.
- Maximum duration: 02 years.
4. Fees for work permit renewal
Legal basis: Clause 4, Article 3 of Circular 85/2019/TT-BTC.
- The fee for work permit renewal is determined by the People’s Council of each locality, generally ranging from 400,000 VND to 600,000 VND per permit.
- Fee for granting work permits for foreigners working in Ho Chi Minh City: 450,000 VND per permit (Article 2 of Resolution 09/2022/NQ-HDND).
